What Should I Do If I’ve Been In An Accident?
- Remain at the scene of the accident
The Texas Transportation Code requires all parties involved in an accident to stay at the scene of a car accident, especially if there are any injuries. Leaving the scene could result in hit-and-run charges, which carry severe penalties. Staying at the accident scene allows you to provide your account of the incident to law enforcement officials, ensuring a more balanced and thorough accident report. It also allows you to gather evidence from the scene, take photographs, and exchange information with the other drivers involved. - Get to a Safe Location
If it is safe and your vehicle is not severely damaged, move it out of the traffic flow to a secure location to prevent additional collisions with other vehicles. If your car is undrivable, turn on your hazard lights and walk to a safe location on the side of the road. Always prioritize your safety and that of others. Cars and property can be replaced or repaired; human lives cannot. - Limit Communication to Exchanging Information
Other than exchanging Information, do not discuss the accident with the other driver. The Texas Transportation Code requires you to exchange certain information with the other driver involved in an accident. This includes your name, address, and vehicle registration number. If asked, you should also provide your driver’s license number. Take note of the other driver’s insurance information as well, including the name of the insurance company and the policy number. If injuries or property damage exceed $1,000, the Texas Transportation Code requires you to report the car accident to the police. If the police can’t arrive at the scene, you should file a crash report, also known as CR-2 Blue form, through the Texas Department of Transportation within ten days of the accident. Your police crash report will typically be available within 7 to 10 days after the accident is reported. - Inform the Police
Call 911 and request for an officer to be dispatched to the scene. Do this yourself rather than relying on the other driver. There are several reasons you should call 911:- It ensures emergency services, including police and medical assistance, are dispatched to the scene promptly.
- When you personally make the call, you have the opportunity to provide a first-hand account of the incident to the emergency dispatcher.
- Even if the accident seems minor, a 911 call officially documents the incident, providing an unbiased third-party record.
- Get Medical Care
Regardless of the severity of the crash, seek medical attention immediately after a car accident. Injuries sustained during a car wreck are often not immediately visible or noticeable and may take hours, or even days, to manifest. Seeking prompt medical attention allows any injuries to be diagnosed and treated early, potentially minimizing their long-term impact. How Much Is My Personal Injury Case Worth?
One of the most frequently asked questions by many people is, how much is my personal injury case worth? Unfortunately, it is difficult for an attorney to accurately answer this question because there are several factors that are unique to each case.
Every case is unique and comes with its own value based on damages. Those damages are defined in Texas as economic (think medical bills) and non-economic damages (things like pain and suffering). An experienced personal injury lawyer is better situated to help you understand the value of your case because he or she will be the one to investigate, build evidence, and review the damages to estimate your claim once more information is gathered.
Here are the types of damages that are analyzed to determine the monetary value of your case:
- Economic Damages
These are damages that have an intrinsic financial value. They are the easiest types of damages to calculate in your case. Common economic damages include:- Medical treatment you have received related to your accident
- Future medical care you will need for your injuries
- Lost income
- Reduced earning capacity or disability
- Property damage
- Non-Economic Damages
These damages do not have a clear financial value. They are also hard to define and consider your quality of life after the accident, how your life has changed, whether you can return to work, and whether you are left with chronic pain or limitations.Common non-economic damages include:
- Pain and suffering
- Emotional distress or the psychological impact of your injury such as anxiety and fear
- Loss of enjoyment of life if you are unable to enjoy the hobbies, exercise, and activities you once did
- Loss of consortium if the injuries have an impact on your relationship with your spouse
These damages may be calculated by multiplying your economic damages by a factor of 1 to 5, depending on the severity of your injuries.
- Punitive Damages
If your case goes to trial, you may be entitled to punitive damages. These damages are uncommon but may be awarded to punish the negligent party for particularly carelessness and/or criminal behaviour. These damages, called exemplary damages in Texas, are capped at the larger of $200,000 or two times the economic damages plus an equal amount of non-economic damages up to $750,000. - The Severity of Your Injuries
Generally, the more injured you are, the higher your case value should be. A broken bone is more severe than a sprained ligament. Likewise, a case where a client had to undergo corrective surgery likely does not have the same case value as a client who did not have to undergo surgery. Therefore, the attorney’s goal is to assess and attain a settlement that properly compensates you for the type of injuries you sustained as a result of your accident.
How Long Does a Personal Injury Lawsuit Take to get a Settlement?
The shortest cases resolve in only a few weeks and without any formal litigation. Sometimes, your attorney can work directly with the other party or the insurance company to reach a swift resolution.
In other cases, litigation can continue for a year or more. Most cases fall somewhere in the middle. The more complicated your case, the longer you can expect it to take. You have some control over the length of your case because it’s up to you to accept or reject settlement offers.
